Quebec- Decision on
Motor Vehicle
Replacement Guarantees
Following consultations
which took place in 2004
and 2006, the Autorité
des marchés financiers
(AMF) has decided
that a motor vehicle
replacement guarantee is
an insurance product
subject to AMF oversight
and must be issued by
insurers. The
regulatory framework
administered by the AMF
gives consumers better
protection against the
risks of insolvency. The
AMF notes that consumers
will be able to contact
the AMF to ask for
information about motor
vehicle replacement
guarantees, file a
complaint and benefit
from mediation services.
There will also be
standardized contracts
and better
identification of the
roles and
responsibilities of each
party involved.
Stakeholders have 12
months to be in
compliance with the
Act respecting the
distribution of
financial products and
services. The AMF
is still considering
options for
distribution, ie whether
or not such products can
be offered using a
distribution guide
process.
